Q. My former partner has paid our mortgage for the last 2 years since he left the home. He also pays maintenance for our 2 children – 9 and 6 years old. Up to now it’s been amicable but he’s just told me he’s going to stop paying the mortgage and I’m worried sick. I work part-time and will not have enough to pay for everything. A. Really sorry to hear this Jenny. The break-up of a relationship is traumatic in itself outside of financial issues. You first of all need to establish your ex partner’s assets and income to see if there are some underlying issues to his announcement.  If your ex cannot agree on a solution between you or via mediation, you could apply to court for a formal maintenance order which would include that mortgage repayment. An application for maintenance can be brought either in the District or Circuit Court. Check the www.courts.ie website for specifics. You should also always check to see if you are eligible for legal aid or contact a private solicitor to assess the cost of the application. The cost of the application can be awarded against the party refusing to pay mortgage / maintenance if a judge considers it appropriate. Each party must disclose their finances to the court and the judge will consider all of the family’s circumstances when making a maintenance order. If you wish to appeal the decision of the court about a maintenance order if it goes against you, you can do so within 14 days or apply to the court for an extension of time to appeal. These clinics are confidential, free of charge and open to all. Contact your nearest Citizens Information Centre for information on FLAC services in your area.
